Been through a similar situation. The minute I contacted the IRB it was amazing how soon the researcher contacted me and appologized for their error. I didn't hear back from the IRB, but I could tell the IRB had been in contact with the researcher. I calmly wrote back to the researcher thanking them for their reconsideration and BCCd the IRB so they knew the result without publicly embarrassing the researcher.
