Well, it depends on the type of reference. They can't shit talk you when just confirming your employement with the "I worked here!" type of reference and can't retailiate for quitting. However, "truthful representation," of your employement history and opinions that don't constitute defamation for your "list 3 professional/personal references," (the type where you are specifically telling them to call this person to talk about how great you are and not just confirming your employement) are allowed and generally protected. TLr - don't use someone as that type of reference unless you know they won't say something bad. I left a contract early, and I list them as a past employer, cause in that case they can't really say much other than that I worked there from x to y, but I would never ever ever use my old manager as a personal reference cause I would fully expect him to say every negative thing he could think of (she missed this deadline, she moved out of the state and cut her contract off early, I didn't like the way she [insert plausible thing here]. That being said, I used a co-worker who was not my direct supervisor as a reference instead and he said great things about me and it worked out a-ok. This is why I always make a few friends at any given job and swap contact info for the future.
